1. Overview

Welcome to Pooch Patriot Co. (“Pooch Patriot,” “we,” “us,” or “our”). We operate this store and website (poochpatriot.com), including all related content, features, tools, products, and services (collectively, the “Services”).

We’re powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make are directly with Pooch Patriot Co.

By visiting or purchasing from our store, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, you may not use our Services.

2. Eligibility & Accounts

You must be at least the age of majority in your state or province to purchase from us, or have a parent/guardian’s consent. You are responsible for keeping your account login secure and for all activity under your account. We may refuse service, terminate accounts, or cancel orders at our sole discretion.

3. Products & Availability

We strive to accurately display our products, but colors, sizing, and materials may vary slightly from what you see on your screen. All descriptions, pricing, and availability are subject to change without notice. We may discontinue any product at any time.

4. Pricing & Payment

Prices are listed in U.S. dollars and may change without notice. Payment must be made in full before shipping. By submitting payment details, you confirm you are authorized to use that payment method and that the information is accurate.

5. Orders

When you place an order, you are making an offer to buy. We reserve the right to accept or reject any order for any reason. Orders may be canceled prior to shipment in our sole discretion. All purchases are subject to our Return Policy.

6. Shipping & Delivery

We currently ship within the United States. Delivery times are estimates and not guaranteed. Once an order leaves our facility or our fulfillment partner’s facility, risk of loss passes to you. We are not responsible for carrier delays, weather, customs processing, or events beyond our control.

7. Use of Products (Pet-Specific Clause)

You are responsible for determining whether a product is safe and appropriate for your dog. Always supervise your pet when using Pooch Patriot products. We are not liable for harm, injury, or damage resulting from misuse, neglect, or unsupervised use.

Please see our Return Policy for full details. Certain items—like grooming products, treats, and personalized gear—are non-returnable unless defective.

9. Intellectual Property

All content on our site—including text, images, logos, product designs, and graphics—is owned by Pooch Patriot Co. or our licensors and protected by copyright, trademark, and other laws. You may not use, copy, modify, or distribute our content without written permission. All rights not expressly granted are reserved.

We may provide access to third-party tools or link to external sites. We do not control these and are not responsible for their content or services. Your use of third-party tools or sites is at your own risk and subject to their terms.

11. Prohibited Uses

You may not use our Services:

To submit false, misleading, or malicious content;
To upload malicious code or interfere with the site’s operation;

If you submit feedback, suggestions, or reviews (collectively, “Feedback”), you grant Pooch Patriot a worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display that Feedback for marketing or operational purposes. 13. Errors & Omissions

We do our best to keep information accurate but reserve the right to correct errors, update information, or cancel orders if any information is inaccurate, including after an order is placed.

14. User-Generated Content (Hall of Paws)

By submitting or tagging content (including photos, videos, stories, or social media posts) for inclusion in the Hall of Paws or any related campaign, you grant Pooch Patriot Co. a non-exclusive, perpetual, worldwide, royalty-free, and sublicensable license to use, reproduce, modify (for formatting or cropping), distribute, publicly display, and create derivative works from your submission for marketing, promotional, or community purposes in any media now known or later developed.

You retain ownership of your content but represent and warrant that:

You own the content or have permission from the owner.
Anyone identifiable in the content has given you permission to share it.
The content does not infringe any copyright, trademark, privacy, or publicity rights, and does not contain offensive, defamatory, or unlawful material.

Pooch Patriot Co. may moderate, edit, or remove submissions at its discretion and is not responsible for how content is shared or embedded once it appears publicly.

15. Third-Party Products and Shopify Collective

Some products sold on poochpatriot.com are fulfilled by third-party partners, including Shopify Collective vendors and print-on-demand suppliers.

The vendor’s name or logo may appear on product listings.
Orders for these products are shipped directly by the vendor, and returns or warranty requests are handled according to that vendor’s policy.
Pooch Patriot Co. does not manufacture or physically inspect these goods and is not responsible for defects, delays, or quality issues beyond facilitating communication with the vendor.
Your purchase of a third-party product constitutes acceptance of that vendor’s fulfillment and return terms in addition to these Terms of Service.

16. Charitable Contributions

From time to time, Pooch Patriot Co. offers products or collections where a portion of the proceeds supports charitable organizations.

For each qualifying item, the specific donation amount, charity name, and campaign period will be clearly stated on the product page or related marketing materials.
Unless otherwise indicated, donations are made to registered U.S. 501(c)(3) nonprofit organizations and are not tax-deductible to the purchaser.
Donations are typically remitted on a quarterly basis following the close of each campaign.
If a designated charity becomes ineligible to receive funds, Pooch Patriot Co. may redirect donations to a comparable animal-welfare or community charity.
Participation in charitable campaigns does not confer any partnership, endorsement, or agency relationship between Pooch Patriot Co. and the beneficiary organization.

17. Privacy & Data Use

Content and contact details you provide through the Hall of Paws, purchases, or sign-ups are processed in accordance with our Privacy Policy, which explains how we collect, use, and safeguard your personal information and how you can request removal of your data or gallery content.

18. Disclaimer of Warranties

Except as expressly stated by Pooch Patriot Co., the Services and all products are provided “as is” and “as available,” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow limitations on implied warranties, so these limitations may not apply to you.

19. Limitation of Liability

To the fullest extent permitted by law, Pooch Patriot Co. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or Services. Our total liability to you for any claim shall not exceed the purchase price of the product in question.

20. Indemnification

You agree to defend, indemnify, and hold harmless Pooch Patriot Co., its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your breach of these Terms or misuse of the Services.

21. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. You consent to venue and personal jurisdiction in the state and federal courts located in New York.

21A. Dispute Resolution & Arbitration

Before taking formal action, you agree to contact us at support@poochpatriot.com to attempt to resolve any issue informally. If a dispute cannot be resolved within 30 days, both parties agree that any dispute, claim, or controversy arising out of or relating to these Terms, our products, or your use of the Services will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Individual basis: Arbitration will be conducted individually; class, collective, or representative actions are not permitted.
Location: Unless both parties agree otherwise, arbitration will occur in New York, NY, or by remote video if available.
Governing law: The Federal Arbitration Act and New York law govern this clause.
Exceptions: You may pursue a claim in small-claims court if eligible or seek injunctive relief for intellectual-property infringement.

By agreeing to arbitration, you waive your right to a jury trial or to participate in a class action. The arbitrator’s decision is final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

We may update these Terms at any time by posting the revised version on our site. Your continued use of the Services after changes means you accept the updated Terms.
